**1. Overview**
This website is owned and operated by Kisstheartist Jefferson. Throughout the site, the terms “we”, “us” and “our” refer to Kisstheartist Jefferson. By accessing or purchasing from this site, you agree to be bound by these Terms of Service.

**2. Products**
Our products consist of digital music files (“beats”) which are sold under various non‑exclusive and exclusive licenses. When you purchase a beat, you receive the rights specified in the applicable license, not ownership of the underlying audio.

**3. License & Usage**
- Non‑exclusive licenses allow you to record vocals over the beat to create a new song and distribute that song according to the stream/view limits set in the license. We retain full ownership of the beat. You may not resell, sublicense, or redistribute the beat as‑is or claim it as your own.
- Exclusive licenses grant full use of the beat for one commercial project and remove the beat from further sale. Ownership and copyright remain with the producer.
- You must credit the producer ("Prod. by Kisstheartist") on all releases and uploads.

**4. Payments & Delivery**
All payments are processed securely through Shopify and its payment providers. Files are delivered electronically via email and/or account download links. Because our products are digital goods, **all sales are final and non‑refundable** once files have been delivered.

**5. Prohibited Uses**
You may not:
- Register the beat or your resulting song with a content ID or fingerprinting service without written permission.
- Use our beats for NFTs, blockchain‑based media, AI training, or other derivative technologies without a separate agreement.
- Infringe our intellectual property rights or distribute pirated copies of our beats.

**6. Modifications**
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

**7. Governing Law**
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law provisions.
